I plan to put on an addition soon.My contractor will hire subcontractors.In the event that the contractor is negligent and fails to pay the subcontractors I am now responsible to pay them.How can I protect myself legally from being sued by the subcontractors if my contractor does not pay them? Is there something called a Mechanics Lien Wavier that I can use?
It's not called that anymore as far as I know but an equivelant is certainly part of all contracts whether it is written in or not. You have to hold back a percentage for at least 30 days after the work is finished on each phase I think. Your lawyer will be the best one to discuss this with. On a contract as large as an addition, you should involve a lawyer anyway.
